- INTRODUCTION
- These are the terms and conditions
on which you may use the PoliticsHome.com website and all the material
and information available on it, including any material or information
provided under a subscription service, and by whatsoever means or device
used for access. By accessing or using PoliticsHome.com you agree that
you will be bound by these terms and conditions. If you are accessing
or using PoliticsHome.com in the course of your business, you are also
agreeing to these terms and conditions on behalf of that business. If
you do not agree with these terms and conditions, or are not authorised
to do so on behalf of your business, you should refrain from accessing
PoliticsHome.com.
- PoliticsHome.com is owned
and operated by Dods Parliamentary Communications Limited (‘Politics Home’),
which may be referred to in these terms and conditions as ‘we’ or
‘us’ and any reference to ‘our’ shall be construed accordingly.

number 01262354, VAT number 792 067 900, Data Protection registration
number Z8858854 and registered office 21 Dartmouth Street, London SW1H 9BP.

- This version of these terms
and conditions is effective from 24 May 2010. We recommend that you
read them carefully, and print and retain a copy for your records. We
may update these terms and conditions from time to time for commercial,
legal or regulatory reasons. Any changes will become effective as soon
as we notify you of them, unless specified otherwise. Notification includes
the publication of revisions on PoliticsHome.com, so we recommend that
you check regularly for any changes as they are binding on you.
- SUBSCRIPTION TO SERVICE
- Free access to PoliticsHome.com
is available but is subject to restricted usage rights unless a subscription
is purchased. Politics Home currently offers two levels of subscription,
Politics Home Pro and Politics Home On The Go (PH On The Go).
These terms and conditions govern the
access to and usage of PoliticsHome.com without subscription, and subscriptions
to PH On The Go.
Politics Home Pro (PH Pro) is an enhanced
service intended primarily for corporate and commercial organisations
and users, including those who need to be able to republish, quote or
otherwise use content from Politics Home. Consequently the PH Pro service
has specific terms and conditions which may differ from those set out
here. If you would like to discuss subscriptions to PH Pro, please contact sales@politicshome.com.
Politics Home reserves the right to vary
the content and types of service available to different categories of
users. This means that we may from time to time increase or reduce the
content and services that are only available to subscribers.
- The subscription charges for
PH On The Go may vary from time to time and depending on whether an annual
or monthly subscription is purchased, and by country. Generally, for
subscribers in the UK and non-business subscribers within the EU charges
will include VAT. Charges will be made clear to you during the signing-up
process on the PoliticsHome.com website.
- You agree to pay the subscription
charges at the rates notified to you at the time you take out your subscription.
Politics Home may offer discounted rates subject to eligibility criteria
which must be confirmed at the time the subscription is taken out.
- You must provide complete
and accurate registration information during the subscription sign up
process. It is your responsibility to update any changes to that information.
We are entitled to rely on any information you provide to us.
- You must provide complete
and accurate payment information when you complete the subscription
sign up process. By signing up, you are confirming your authority to
use those payment details to purchase a subscription. If any authorisation
is not received or subsequently cancelled or rescinded, we may immediately
terminate your subscription or suspend access.
- Politics Home will endeavour
to process your subscription application and payment promptly, but cannot
guarantee that the subscription will be operational by any specific
time. A contract is formed only when your payment has been authorised
and email address verified.
- Politics Home reserves the
right, in its absolute discretion, to decline any request for a subscription.
- Subscriptions will be automatically
renewed at the end of your subscription period, whether annually or
monthly, unless you tell us, at least seven days
before the end of your subscription period, that you wish to cancel
your subscription. Renewals will be charged using the card details previously
provided. You will be informed in advance of any changes to the subscription
price which will apply on renewal.
- You may cancel your subscription
before we have started providing any part of it, and we will provide
you with a full refund. Otherwise, you agree that you have no right
to cancel your subscription or any part thereof until the end of the
current subscription period. You may notify us of your intention to
cancel at any time, but this cancellation will only be effective from
the end of your current subscription period.
- In the event of a pricing
error, if a price for a subscription is incorrectly quoted, we are not
obliged to provide you with a subscription even if we have in error
accepted your offer to buy such subscription. We reserve the right to
notify you of any pricing error, when you may cancel your subscription
without any obligation and receive a full refund, or alternatively pay
the correct price.
- USER ACCESS AND USE OF
THE SERVICE
- A user name and password is
required for each registered user or subscriber to access the subscription
services. This is personal to you and is not to be used by anyone
else. You are not permitted to share your user name and password with
anyone else. This is a breach of these terms and may constitute copyright
infringement. Politics Home may monitor access and usage to prevent
the sharing of user names and passwords.
- You are responsible for all
access to and use of the web site and subscription using your user name
and password, including misuse by a third party resulting from any breach
of these terms and conditions. You will notify Politics Home as soon
as reasonably practical if there has been any unauthorised use of your
user name and password or other breach of these terms.
- You must not misuse PoliticsHome.com
by knowingly introducing viruses, Trojans, electronic bugs or any other
malicious or technologically harmful material. Any breach of this provision
would be an offence under the Computer Misuse Act 1990 and will be reported
to the relevant authorities.
- USE AND DISCLOSURE OF FINANCIAL INFORMATION
- PoliticsHome at no stage keeps a record of the credit card or other financial information of its subscribers. The payment system is entirely operated by PayPal, a secure third party payment system, and PoliticsHome never has a copy of any financial information.
- POLITICS HOME OBLIGATIONS
AND LIMITATION OF LIABILITY
- We aim to update PoliticsHome.com
and the subscription services regularly, and may change the Content
(which means the content, material and information available on PoliticsHome.com
and in subscription services) at any time. We may need to suspend access
from time to time, and will not be liable if for any reason the site
is unavailable at any time or for any period.
- We cannot guarantee the speed
or security of PoliticsHome.com. We shall not be responsible for the
presence of any viruses, Trojans, electronic bugs or other malicious
or technologically harmful material and any damage that may be caused
or loss suffered directly or indirectly.
- We will use reasonable skill
and care at all times in generating and publishing Content and providing
each user with access to PoliticsHome.com and subscription services.
- We do not monitor the content
of other web sites, and any links provided are for your convenience
only. We make no representation or warranty as to the content of third
party websites. To the maximum extent permitted by law,
we exclude all liability for any third party material made available
on PoliticsHome.com or contained in any third party website linked to
it. Any contract concluded with a third party company of a linked site
will be between you and that company only and will be subject to their
terms and conditions. You are responsible for viewing the privacy policy
and terms and conditions in respect of any linked site.
- PoliticsHome.com and PH On The Go
are for your general information purposes only and are not intended
to address specific requirements. You acknowledge that because of the
number of sources from which Politics Home obtains Content and the nature
of electronic distribution via the World Wide Web:
- we do not give any warranties
in respect of any Content which is provided on an ‘as is’ basis
without guarantee, condition or warranty of accuracy or completeness;
- we do not guarantee the availability
or timeliness of PoliticsHome.com or any Content; and
- The warranties or conditions
of satisfactory quality, merchantability and fitness for a particular
purpose are excluded to the fullest extent permitted by law.
- Subject to clause 4.8, Politics
Home's aggregate liability in respect of any loss, damage, liabilities
and expenses to you and arising out of or in connection with these terms
and conditions, whether in contract, tort (including negligence) or
for breach of statutory duty or in any other way, shall not exceed the
charges paid by you during the extant subscription period.
- Politics Home shall not be
liable in contract, tort (including negligence) or for breach of statutory
duty or in any other way for any direct, indirect, consequential loss
or damage that anyone may suffer or may be incurred arising out of or
in connection with the use of PoliticsHome.com or any subscription services
including, without limitation, any liability for:
- any loss arising from or in
connection with loss of revenues, profits, data, contracts or business
or failure to realise anticipated savings;
- any loss of goodwill or reputation;
or any indirect or consequential losses;
- any damages arising from failure
by you to use PoliticsHome.com and/or subscription services in accordance
with these terms and conditions;
- wasted management or office
time ;
- any other loss or damage of
any kind howsoever arising and whether caused by tort (including negligence),
breach of contract or otherwise, even if foreseeable;
- third party claims of any
kind.
- Nothing in these terms and
conditions shall limit Politics Home’s liability for death or personal
injury resulting from negligence or fraud or fraudulent misrepresentation.
- COPYRIGHT
- The copyright, database, trade
marks, domain names and other intellectual property rights in all Content
belongs to us or, if it has been licensed to us, to the licensor. No
rights whatsoever in or to any Content are assigned to you.
- Under no circumstances will
you have any claim to copyright or ownership of any intellectual property
rights in any Content.
- You may not further reproduce
printed Content, or distribute printed Content, or use the Content,
except as permitted under section 6 below.
- Any proceeds from unauthorised
reproduction or distribution whether in cash, or a cash amount equivalent
to the value to you of any non-financial reward shall be held by you
on trust for Politics Home absolutely.
- USE OF THE CONTENT
- You are permitted to
- View and download Content
for your personal, non-commercial, use only on any compatible device
- Print copies of Content for
your personal, non-commercial, use only.
- If you print or download copies
of the Content you must retain copyright or other intellectual property
notices in the original material. You must not modify paper or digital
copies of any Content. You must always acknowledge our status, and that
of any identified contributors, as authors of the Content.
- You are not permitted to use
PoliticsHome.com or the Content other than as set out above. This means
that you must not, inter alia:
- Republish, resell, distribute,
reproduce, modify, store, transfer or in any other way use any of the
Content, other than as expressly set out in these terms and conditions
or with the prior written authority of Politics Home.
- Create an archive or database
containing all or parts of the Content for any business purpose or commercial
exploitation without our specific prior written consent
- Use the Politics Home or PoliticsHome.com
name in any way, including in advertising or publicity materials, without
our prior written consent
- Use our logo as a link to
PoliticsHome.com without our prior written consent
- You agree to notify Politics
Home as soon as reasonably practical in writing of any misuse of the
Content and/or PoliticsHome.com
- You agree to permit Politics
Home to take such steps as it reasonably considers appropriate to monitor
the level of usage of subscription services and the Content and user
compliance with the provisions of these terms and conditions and to
co-operate fully with Politics Home in relation to all such monitoring.
- USER GENERATED
CONTENT
- PoliticsHome.com may include
discussion forums, blogs and comments that allow interaction by users.
Any information posted to a discussion, forum, blog or as a comment
is called User Generated Content (UGC).
- If you post or view UGC, then
you must comply with any specific rules posted. You retain ownership
of the copyright of your UGC. You are responsible for the content of
any of your UGC, and are financially responsible to us for any claim
against us or any third party relating to your UGC.
- You agree to post only UGC
that is
- Your original content, and
not infringing any copyright or other rights of any third party
- Not any form of advertising or promotion
- Not in any way threatening,
libellous, abusive, indecent or in any way unlawful
- You also agree not to
- Impersonate any person or
misrepresent any person or entity
- Not to collect or store any personal
data relating to other users
- Not to restrict or inhibit or attempt
to restrict or inhibit other users
- You agree that in posting
UGC you are waiving any moral rights you have may have and granting
us a non-exclusive, perpetual, royalty-free, worldwide license to use
any UGC published by you in any manner (including quotation)
and for any purpose without obligation to you.
- It is not possible for us
to monitor in full all UGC published on PoliticsHome.com, and we therefore
cannot guarantee the integrity or accuracy of any UGC, or that it is
not misleading, false or that it may not cause offence to other users.
If you believe that any UGC breaches any of these terms and conditions,
or any legal rights, you should provide the specific details immediately
to us at sales@politicshome.com . When we receive any complaint about UGC, we
will review it and act accordingly, which may include the removal of
the UGC. We have the right to remove any of your UGC in our absolute
discretion.
- We have the right to disclose
your identity to any third party who is claiming that any of your UGC
constitutes a violation of their intellectual property rights,
their right to privacy or is defamatory.
- GENERAL
- These term and conditions
shall be governed by, and construed in accordance with, the laws of
England and Wales and the courts of England shall have exclusive jurisdiction
to settle any dispute which may arise out of, under, or in connection
with these terms and conditions.
- Each party irrevocably waives
any right it may have to object to any action being brought in those
courts, to claim that the action has been brought in an inappropriate
forum, or to claim that those courts do not have jurisdiction.
- In the event that any provision
of these terms and conditions is held to be invalid or unenforceable,
the invalidity of that provision shall not affect the remaining provisions
of these terms and conditions which shall remain in full force and effect.
- You consent to use by Politics
Home of all details provided by you in accordance with the Privacy Policy
published on PoliticsHome.com at www.politicshome.com/privacy_policy.html.
- You may not assign, license,
sub-license or otherwise transfer any of your rights or obligations
under these terms and conditions. Politics Home may transfer any of
its rights or obligations to any company within the same group of companies.
- Any failure by either party
to exercise any right or remedy under these terms and conditions does
not constitute any waiver of that right or remedy.
- No person
who is not a party to these terms and conditions shall have any rights
under or in connection with these terms and conditions by virtue of
the Contracts (Rights of Third Parties) Act 1999 and the rights of the
parties to terminate, rescind or agree any variation, waiver or settlement
under these terms and conditions shall not be subject to the consent
of any third party.
